For JİHİDEM to cover Human Rights violations;

1.The person who is responsible for the violation should be a Gendarmerie personnel,

2.This personnel should be carrying out a duty determined by laws,

3.The violation should take place while carrying out the duty or it should be related to that duty,

4.The violation should be targetted at human honour or it should violate fundamental rights and freedoms,

5.The violation should be considered as an offence in accordance with the Turkish Penal Code (TPC 243 An officer’s torturing the accused and treating him badly to make him admit his offence, TPC 245 officers’ ill treatments and effective actions etc.) or the agreements which our country is a party,

6.Furthermore, applications should be made within the legal process as from the occurance of the event alleged with regard to the type of offence.
